We are all concerned about the abuses and conditions in which our children are suffering at the hands of California and their political subdivisions, the counties. We are particularly concerned in Santa Clara County with the abuses in the Juvenile Justice system. In order to help or save your children, you must notify the abusing agencies or authorities in WRITING that these abuses are going on. Making a phone call to the jail, county, state, federal agencies, social workers or probation officers will do NOTHING. All complaints must be done in writing and you must hand serve them with a process server, a witness who can testify that they received them or by registered mail with a return receipt. You must keep a copy of the complaint in a secure file with your records, as the agency you are complaining about will loose your complaint (if it is true). Make absolutely sure that the complaint is true and correct and that you keep any and all evidence. At some time in the future, you may need to provide this complaint and the evidence to an attorney as part of a civil or civil rights lawsuit. Good records are extremely important!!!

Who do you complain to and what should it contain? Normally you start at the bottom and work your way up the chain of command. This means that if you are having problems in a specific county like Santa Clara County (SCC), then that is whom you complain to first. If they give a inadequate response or do nothing to resolve the harm to your child, then the next agency is the State of California for they administer the juvenile justice system and receive federal money to distribute to each of their political subdivisions, i.e. the counties like SCC.  However, time is of the essence, so we recommend that you Cc: all parties as noted or discussed.

 

Since the state and counties receive federal monies, they are required under federal laws to have a administrative complaint process. Administrative law governs all actions of the juvenile system probation officers or social workers.  This is generally consistent throughout the United States through federal oversight.  The administrative complaint process or State Fair Hearing is clearly shown in 45 CFR 205.10 et. seq.; XIV Amend. U.S. Constitution and Title 22 Division 22 22-000 et. seq. pursuant to California’s state plan. ACF is looking at other applicable state and federal codes at this time. It is further detailed in the California Welfare and Institutions Code (WIC) sections (§§) 10850 or other administrative codes to be determined. Administrative law is that legal process in which the Juvenile and social services system operates. Judicial law operates the court system. The administrative complaints are to be performed in a State Fair Hearing or the probation complaint, attached and as outlined in California and federal laws. ACF is currently investigating the process in the Juvenile system under WIC, to make sure that it conforms to both state and federal requirements for receiving federal funding.

         

ACF is providing this document for guidance to our concerned parents so that we can best stop the abuse to our children and stop the consistent harm our children face on a daily basis. ACF as a group of concerned parents have seen consistent abuse of the same type occurring to our children and therefore we have prepared a general complaint form, attached, which outlines these consistent abuses that are harming our children. ACF will be providing the attached general complaint letter to be sent to the supervising agencies whose employees or actions are harming our children.

 

Please check off the boxes, which apply to your specific case in which you have specific proof that these are occurring. We are also providing blank spaces in which you can write other specific complaints or issues, which apply to you or your child’s case. Make sure that you fill out all of the blanks with your name, address, date and sign and date the complaint. Make a copy for your self and then mail your complaint to the appropriate agencies. We have provided below a list of potential agencies and the order in which you should file complaints.

 

This is only a suggested list and if you have questions or other agencies, please send complaints to them also and let us know so that we can share these ideas with all of our parents. Only working together can we stop the abuse of our children.
